1. Acceptance of Terms
By accessing and using the services provided by Above Human Standards Performance ("AHS Performance," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Services
AHS Performance provides athletic training, speed and agility training, strength and conditioning, and related fitness services. Our services are designed to help athletes improve their performance through personalized training programs.
3. Eligibility
Our services are available to individuals of all ages. For participants under 18 years of age, a parent or legal guardian must provide consent and may be required to be present during training sessions. By enrolling a minor, the parent or guardian agrees to these terms on behalf of the minor.
4. Health and Safety
Prior to participating in any training program, you must:
- Disclose any medical conditions, injuries, or physical limitations
- Obtain medical clearance if recommended by a healthcare provider
- Inform trainers of any changes to your health status
- Follow all safety instructions provided by our staff
Participation in athletic training involves inherent risks of injury. You acknowledge and accept these risks by participating in our programs.
5. Assumption of Risk and Waiver
By participating in AHS Performance training programs, you voluntarily assume all risks associated with physical exercise and athletic training. You agree to release, waive, and discharge AHS Performance, its owners, employees, trainers, and affiliates from any and all liability for injuries, damages, or losses that may occur during training.
6. Payment and Cancellation
Payment terms are established at the time of enrollment. Cancellation policies include:
- 24-hour notice required for session cancellations
- Missed sessions without proper notice may be forfeited
- Refunds are subject to our refund policy at the time of purchase
- Package expirations are determined at the time of purchase
7. Code of Conduct
All participants are expected to conduct themselves in a respectful and sportsmanlike manner. AHS Performance reserves the right to terminate services to any individual who violates our code of conduct, including but not limited to disrespectful behavior, harassment, or failure to follow safety protocols.
8. Intellectual Property
All training programs, methodologies, content, and materials provided by AHS Performance are proprietary and protected by intellectual property laws. You may not reproduce, distribute, or use our materials without written permission.
9. Media Release
By participating in our programs, you grant AHS Performance permission to use photographs, videos, and testimonials for promotional purposes unless you opt out in writing.
10. Limitation of Liability
To the fullest extent permitted by law, AHS Performance shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
11. Modifications
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Michigan. Any disputes shall be resolved in the courts of Wayne County, Michigan.
